Acquisition of Information on Entities Located Offshore

In May 2013, the National Tax Agency (NTA) received from the Australian Taxation Office (ATO) information that is part of a substantial amount of data on entities (such as corporations and trusts) located offshore (that is, in so-called tax havens) and could be related to Japanese taxpayers. The NTA expresses its gratitude to the ATO for sharing the information.

The tax administrations in Australia, the U.S. and the U.K. announced from May 9 to 10 that they had obtained massive information on entities located offshore and will investigate these issues. In addition, the following statements were made on May 17 by the OECD Forum on Tax Administration held in Moscow.

  • Three of our members have obtained a very significant amount of data, revealing complex offshore structures and will now use this data to share information relevant to other members.
  • As heads of tax administration, we are committed to co-ordinated action and united in our resolve and determination to tackle trans-national tax fraud, tax evasion and aggressive tax planning.

The NTA is actively exchanging information with foreign tax administrations based on tax treaties and other related conventions and closely working with them to prevent international tax non-compliance and achieve proper taxation. The NTA has already started analyzing the information received from the ATO and hopes to use it as a trigger to discover international tax dodging and identify those who are obliged to submit the overseas assets report of which submission will be made obligatory from the next year (2014).
